Welcome to AIGCVA. Please read these Terms of Service ("Terms") carefully before using our services.

AIGCVA (the "Platform", "we", "our", or "us") operates the website www.aigcva.com, the AI image and video generation application, and related software and services (collectively, the "Services"). By accessing or using the Services, you ("you", "your", or the "user") acknowledge that you have read, understood, and agree to be bound by these Terms, forming a binding agreement between you and AIGCVA.

If you are using the Services on behalf of a company, organisation, or other entity ("your organisation"), you represent and warrant that you are authorised to bind that entity to these Terms.

If you do not agree to these Terms, you may not use the Services.

1. Eligibility

You confirm that you have the legal capacity to enter into these Terms and that you are at least 18 years old, or have reached the minimum age required in your jurisdiction to use online services with the consent and supervision of a parent or legal guardian.

The Services are not intended for unsupervised use by minors. Minors may not use paid or top-up features except where operated by, or with the express consent of, a parent or legal guardian, who remains responsible for supervising that use.

2. Your Account

You must provide accurate and complete information when registering. We may suspend or terminate your account if any information is found to be false, misleading, or incomplete.

You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at aspxemail@gmail.com if you become aware of any unauthorised use or security vulnerability.

Unless expressly authorised, you may not register using another party's name, or a username that is unlawful, offensive, misleading, or infringing.

3. The Services

AIGCVA provides an integrated interface to third-party and proprietary generative AI models for creating and editing images and videos from text prompts, reference images, and other inputs.

We may add, modify, suspend, or discontinue any part of the Services, including individual models, at any time. Third-party models are provided subject to the availability, capabilities, and policies of their respective providers, and their performance, output quality, and pricing may change without notice.

4. Fees, Subscriptions, and Payment

4.1 Pricing

We may set and modify prices, credit rates, and fees at our discretion. The pricing displayed in the relevant interface at the time of purchase reflects the current applicable rates.

Changes to subscription fees take effect at the start of your next billing cycle. Continued use of a subscription after that date constitutes acceptance of the updated pricing.

4.2 Payment

When purchasing a subscription or credits, you may be required to provide payment details. You represent and warrant that you are authorised to use the payment method provided and that all information submitted is accurate and complete.

We use third-party payment processors to handle transactions. By submitting payment information, you consent to its transmission to those processors in accordance with our Privacy Policy.

4.3 Free Trials

We may offer time-limited or feature-limited free trials at our discretion. You may be required to provide payment details when enrolling; you will not be charged until the trial period ends. We may modify or withdraw trial terms at any time.

4.4 Subscription Term and Renewal

Certain features are available only with a paid subscription. Subscriptions are billed in advance on a monthly or annual cycle, depending on the plan you select, and renew automatically on the same terms unless cancelled before the end of the current period.

4.5 Cancellation

You may cancel automatic renewal at any time through your account settings or by contacting us. Cancellation stops future billing; you retain access to paid features until the end of the period already paid for.

4.6 Refunds

Generated content and credits are digital goods delivered immediately upon use and are consumed at the point of generation. Except where a refund is required by applicable law, or where a charge results from our own technical error or duplicate billing, fees already paid are non-refundable and credits are non-transferable. Please review your plan before purchasing.

4.7 Promotions

Promotional activities may be governed by additional rules. Where promotional rules conflict with these Terms, the promotional rules prevail for that activity.

5. Your Content and Prompts

"Your Content" means the prompts, reference images, videos, audio, documents, and other materials you submit to the Services.

You are solely responsible for Your Content, including its legality and appropriateness. You represent and warrant that you own Your Content or have all rights and permissions necessary to submit it, and that it does not infringe any copyright, trademark, privacy, publicity, personality, or other right of any third party.

You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and process Your Content solely to the extent necessary to operate, secure, and improve the Services, including transmitting it to the third-party model provider required to fulfil your request. This licence ends when you delete Your Content, subject to reasonable backup retention periods.

Do not submit sensitive personal information, trade secrets, or confidential material to the Services.

6. Generated Content

"Generated Content" means the outputs produced by the Services from Your Content.

Subject to your compliance with these Terms and with any applicable requirements of the underlying model provider, you may use Generated Content for personal and commercial purposes. Outputs are delivered without AIGCVA watermarks.

You acknowledge that:

  • Outputs are not unique. Generative models may produce similar or identical results for other users submitting similar inputs. We make no representation that Generated Content is original, novel, or exclusive to you.
  • Copyright status varies. The legal protection available for AI-generated material differs by jurisdiction and may be limited or unavailable. We make no warranty as to the copyrightability of Generated Content.
  • You are responsible for your use. You must ensure your use of Generated Content complies with applicable law, third-party rights, and any platform disclosure requirements for AI-generated media.
  • Provider terms apply. Generated Content produced through a third-party model remains subject to that provider's usage policies.

7. Acceptable Use

You agree not to misuse the Services or use them in violation of any applicable law. You must not use the Services to create, upload, or distribute content that:

  • Violates any applicable domestic or international law or regulation.
  • Sexually exploits, endangers, or depicts minors in any manner.
  • Constitutes pornographic, sexually explicit, or adult-oriented material.
  • Depicts graphic violence, self-harm, or promotes terrorism or violent extremism.
  • Infringes any copyright, trademark, patent, trade secret, or other intellectual property right.
  • Uses the likeness, voice, or identity of a real person without authorisation, including deepfakes and non-consensual synthetic imagery of identifiable individuals.
  • Impersonates any person or entity, or misrepresents your affiliation with any person or entity.
  • Is defamatory, harassing, threatening, discriminatory, hateful, or intended to intimidate.
  • Constitutes fraud, phishing, deceptive advertising, or disinformation, including fabricated news, fraudulent documents, or synthetic evidence.
  • Generates counterfeit currency, identity documents, or other forgeries.

You further agree not to:

  • Interfere with, disrupt, or place undue load on the Services or their infrastructure.
  • Use bots, scrapers, automated scripts, or unauthorised access methods, or circumvent rate limits, quotas, or authentication.
  • Attempt to bypass, disable, or manipulate content safety filters or moderation systems.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code or model weights underlying the Services.
  • Resell, sublicense, lease, or redistribute the Services or access to them without our written authorisation.
  • Use the Services or their outputs to develop, train, or improve a competing generative AI model or service.
  • Upload malware, or manipulate reviews, ratings, or the reputation of the Platform.

We may review, filter, remove, or refuse to generate content that we reasonably believe violates these Terms, and may suspend or terminate access and pursue remedies for losses caused by such violations. Where content you have created is found to be in breach, you must cease using and distributing it immediately.

7.1 Full Content Policy

The complete version of these rules — including the detailed breakdown of prohibited categories, our moderation process, severity levels, and the enforcement ladder — is set out in our Acceptable Use Policy. That policy forms part of these Terms and carries equal force.

7.2 Reporting Violating Content

If you encounter content or conduct that violates these rules, you can report it to us:

  • Reporting email: aspxemail@gmail.com, with "Content Report" in the subject line
  • Urgent cases: for child safety concerns or imminent real-world harm, also include "URGENT" in the subject
  • Please include: the link or task ID of the content, the type of violation, a description of the problem, screenshots if available, and your contact email

We provide an initial response to reports of serious violations within 24 hours, and to other reports within 2 to 5 business days, then review and action them according to severity. We keep the reporter's identity confidential to the extent permitted by law. Full response targets, enforcement actions, and the appeals process are set out in our Acceptable Use Policy.

7.3 Enforcement and Appeals

Where a violation is confirmed, we may — depending on severity — refuse generation, remove content, restrict features, or suspend or permanently ban the account, and will report suspected criminal conduct to the competent authorities. If you believe an action against you was mistaken, you may appeal within 30 days of the notice by writing to aspxemail@gmail.com with "Moderation Appeal" in the subject line; the appeal is reviewed by someone not involved in the original decision.

8. Intellectual Property

The Services, including the Website, application, software, interfaces, text, graphics, logos, and the AIGCVA name and marks, are owned by us or our licensors and are protected by intellectual property laws. Except for the rights expressly granted in these Terms, no licence to our intellectual property is granted.

Copyright in third-party search results, reference materials, or model outputs surfaced through the Services remains with the original rights holder, and you must comply with the applicable terms of that provider or data source.

9. Publicity

With your prior consent, you agree that we may reference your name and logo in sales materials, on the Website, and in marketing content and press releases. You may withdraw that consent at any time by contacting us.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Generative AI models are probabilistic. Outputs may be inaccurate, incomplete, unexpected, offensive, or unsuitable for your intended use, and may misrepresent facts, people, places, or events. Do not rely on Generated Content as professional, legal, medical, financial, or factual advice. You are responsible for reviewing outputs before use.

We are not liable for interruptions or losses arising from: viruses, trojans, or malicious attacks; failure of your hardware, software, or network; your own operational errors; use of the Services in a manner not authorised by us; third-party model provider outages or policy changes; or events beyond our reasonable control.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AIGCVA and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of or inability to use the Services.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Services will not exceed the greater of (a) the total amount you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100).

Some jurisdictions do not allow certain limitations of liability, in which case the above limitations apply only to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless AIGCVA and its affiliates from and against any claims, damages, liabilities, losses, and reasonable costs — including legal fees, notarisation fees, audit fees, and other reasonable enforcement expenses — arising from your breach of these Terms, your misuse of the Services, Your Content, or your use of Generated Content.

13. Suspension and Termination

We may suspend or terminate your access to the Services, with or without notice, if:

  • You breach these Terms or any applicable law or regulation.
  • You fail to provide accurate information where required by law.
  • We are required to do so by a judicial, regulatory, or law enforcement authority.
  • Security, fraud, or other operational concerns make suspension necessary.

You may stop using the Services at any time and may request account deletion as described in our Privacy Policy. Provisions relating to ownership, disclaimers, limitation of liability, and indemnification survive termination.

14. Changes to the Services and These Terms

We may adjust, suspend, interrupt, or discontinue the Services based on operational or business requirements.

We may amend these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Where permitted by applicable law, your continued use of the Services after the effective date constitutes acceptance of the amended Terms. If you do not agree, you must stop using the Services.

In the event of a merger, acquisition, division, or transfer of assets, we may assign these Terms and the related rights and obligations to a third party, and will provide notice where required.

15. Governing Law and Disputes

These Terms are governed by the laws applicable at our place of establishment, without regard to conflict-of-law rules, except where mandatory consumer protection law in your country of residence provides otherwise.

16. General

  • Severability: if any provision is held unenforceable, the remaining provisions remain in full force.
  • No waiver: our failure to enforce a provision does not waive our right to enforce it later.
  • Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
